Host Communications and Platform Terms of Service Agreement
Draft for attorney review. This implementation draft is not legal advice and must not be published as final legal terms without counsel.
1. Parties and purpose
This agreement is between Make Everyone Great Again d/b/a Human Gold (the Platform) and the enrolled church, community group or organizer (the Host). It governs organization-scoped events, RSVPs, attendance, communications and reporting.
2. Host authority
The signer represents that they may bind the Host. Access is personal, revocable and limited to assigned organizations and events. Credentials and recognized devices may not be shared. Attendee registration, Greeter-only authority and authority for another organization do not authorize acceptance for this Host.
3. Fees and funding
The organizer license is a $12 annual Miner membership unless a published order states otherwise. It provides Admin eligibility and the organization/event licensing rights described below; it does not purchase SMS, email or OTP usage. Except for the designated first-pilot fallback, communications funding is a separate required condition. Both are required for ordinary non-pilot registration, and neither substitutes for the other.
3A. Membership license
An active membership is required before the named beneficiary receives Admin eligibility to manage the Host profile, events and RSVPs; create Practice FAITH campaigns; customize Human Gold QR postcards; accept volunteers and assign roles; and access organization reports. It never grants platform Super Admin authority.
3B. Required communications funding
Email service is selected, funded and controlled by the Host. Except for the designated first-pilot fallback, SMS and OTP are funded through the Host provider or an approved Sponsor arrangement. A prepaid Host account requires a $25 opening communications reserve before ordinary new-device registration is enabled; a postpaid account must maintain valid billing and service availability instead. Provider funds remain controlled by the Host and are not a deposit, investment, consumer stored value or fee retained by Human Gold. The Host authorizes reasonable pre-event readiness testing.
4. Communications responsibility
The Host controls routine recipients, sender identity, content, cadence, provider and consent basis. The Host must use verified sender information, honor opt-outs and comply with applicable messaging and privacy requirements. Consent, STOP suppression and rate limits apply across Host and Human Gold transactional senders; switching providers never resets consent. Provider credentials must use the secure connection and must not be disclosed to attendees, Greeters or unauthorized personnel.
5. Designated first-pilot fallback
Before registration opens, Host Twilio or another approved provider must pass configuration, funding-readiness and end-to-end test-OTP checks. It remains primary. If an essential registration or security OTP definitively fails during the designated pilot window because of credential failure, insufficient funding, provider rejection, confirmed non-delivery or provider outage, Human Gold may invalidate the failed code and make one capped, platform-sponsored transactional attempt under the same registration session. A merely pending or delayed carrier status does not trigger a duplicate, and simultaneous duplicate codes are prohibited. The fallback excludes campaigns and promotions, creates no ongoing entitlement and cannot guarantee carrier delivery. Failed delivery never silently registers a device or completes an RSVP.
6. Future-event readiness
After the pilot window and grace period, Human Gold may pause publication or future new-device registrations until the Host provider is repaired, funded and retested. Existing registered devices and completed records are not erased. Continuing platform-provided communications requires a separate written plan or Sponsor approval.
7. Data and privacy
The Host may access only its organization-scoped records, may use attendee data only for disclosed purposes, must promptly remove former operators and may not sell contact data. Public or cross-organization reporting must be de-identified and apply small-cell safeguards.
8. RSVP, attendance and XP
Observe and Participate are event choices, not membership roles. Attendance requires the defined two-device confirmation; passive location does not create attendance. XP Human Gold is nonmonetary recognition, not money, cryptocurrency, property, credit or a promise of value.
9. Suspension and termination
Human Gold may suspend appropriate functions for nonpayment, failed communications readiness, security risk, misuse, unlawful messaging or privacy violations. A communications pause does not erase devices, RSVPs or audit records. Expiration may make a dashboard read-only while lawful retention and audit duties continue.
10. Digital acceptance
Acceptance may be digital or paper. For digital acceptance, the server first confirms current Host/Admin authority for this exact Host; typing a full name and affirmatively agreeing signs this exact displayed version. Human Gold records the agreement key/version, typed name, authorized identity, Host, server time, required document checksum and salted hashes of supporting IP and browser/device evidence. Raw IP and browser/device strings are not passed to or stored by the acceptance adapter. A missing, stale or altered checksum is rejected.
One acceptance covers this agreement version across the Host's events; the designated pilot event is an operational designation, not a separate contract. A new signature is required only for a materially revised agreement version or a legally necessary change in the Host's authorized contracting party.
